Rozelle Bay land owner's right upheld in Supreme Court

4 October 2013

A Supreme Court decision today has upheld the right for Roads and Maritime Services to recover possession of its land at Rozelle Bay.

Roads and Maritime started proceedings against Devine Marine Group Pty Ltd and Consistent Shipping Pty Ltd in September 2012.

The hearing started on Monday 23 September 2013 and was completed on Friday 27 September 2013.

Today’s judgement included an order for Roads and Maritime’s costs to be paid.

The land will need to be vacated and returned to the care of Roads and Maritime shortly in accordance with law, after the Supreme Court judgment.

Roads and Maritime is the State Government agency with responsibilities including management of the road network, licensing of drivers and boat skippers as well as for marine safety and managing property and submerged lands in Sydney Harbour, Newcastle Harbour, Botany Bay and Port Kembla.
